Terms of service

Emote is operated by Experimental Software ("we," "us"). These terms cover useemote.com, its playground, and the Emote API. By creating an account or using the service, you agree to these terms. If you use Emote for an organization, you must have authority to agree on its behalf.

What Emote provides

Emote evaluates messages, conversation context, and agent instructions to select an allowed emoji or "none." AI reactions can be incorrect or inappropriate. You are responsible for deciding when and where to display them, testing your integration, and offering appropriate controls to your users. Emote does not guarantee a particular reaction, response time, or uninterrupted availability.

Your account and your users

You must be at least 18 and provide accurate account information. Keep your account and API keys secure, run API calls from your server, and notify us of suspected unauthorized use. You are responsible for activity under your account and for your application's use of Emote.

Only submit content you have the right to process. Give your users the notices and obtain the permissions needed to send their messages to Emote and its inference provider, TypeSafe. Do not send passwords, payment-card details, or information that requires safeguards we have not agreed to provide. Our privacy notice explains how information is handled.

Do not use Emote unlawfully, infringe others' rights, abuse the free trial, share access to evade limits, probe other users' accounts, or interfere with the service. We may suspend access to address abuse, security threats, nonpayment, or a material breach of these terms.

Pricing and usage

The free trial includes 1,000 evaluations once per account. The Developer plan costs US $100 per month and includes 100,000 evaluations per billing period. Any applicable taxes are shown at checkout. Paid subscriptions renew automatically each month until canceled.

A successful reaction decision uses one evaluation, including "none." Failed requests and requests with an empty reaction list do not count. Replays of a completed request using the same valid idempotency key do not count again. Unused evaluations do not roll over. Requests stop when your allowance is exhausted; we do not automatically charge overages. API requests are also subject to the documented rate and input limits.

Cancellation and refunds

Cancel from the billing portal in your dashboard before your next renewal. Cancellation takes effect at the end of the paid billing period; you can use the remaining allowance until then. Deleting an API key does not cancel a subscription. Contact us if you cannot access your account or need help with a billing error.

Payments are generally nonrefundable, and we do not provide prorated refunds for unused evaluations or partial months, except where required by law or where we agree otherwise. Nothing here limits mandatory consumer rights. Contact us to request account closure and deletion.

Your content and our service

You retain your rights in the content you submit. You authorize us and our service providers to process it to deliver and secure Emote. We do not claim ownership of your inputs or the reactions returned to you. The Emote software, branding, and website remain ours or our licensors'.

Availability and liability

To the extent allowed by law, Emote is provided "as is" and "as available," without warranties of merchantability, fitness for a particular purpose, or noninfringement. We are not liable for indirect or consequential losses, lost profits, or lost data. Our total liability arising from the service is limited to the greater of US $100 or the amount you paid us in the 12 months before the claim. These limits do not apply where the law prohibits them.

Changes and contact

We may update Emote and these terms. We will provide reasonable notice of material changes, and price increases will apply only to future billing periods after notice. If you disagree with a change, stop using Emote and cancel any subscription before it takes effect.
